Turbine dealer agrees to restitution payments
Former state Rep. Mark Howland, whose wind turbine company was shut down for misleading consumers, has worked out an interim payment plan with the state Attorney General's Office for nearly $600,000 in restitution owed to consumers.
Under the plan, Howland must pay the state $2,000 per month from last month to April, attorney general spokeswoman Jill Butterworth said. The office will hold the money in escrow for more than 160 consumers, many in Southeastern Massachusetts, who purchased faulty turbines from Howland's company, WindTech-Co. of Freetown.
The state has received Howland's first $2,000 payment for November, she said.
In addition to the payments, Howland's real estate broker must provide the office with regular updates on efforts to sell his three undeveloped parcels of land in Lakeville. The property, which totals some 26 acres, sits off Howland Road.
If the land is not sold by April 15, the state "will likely foreclose on the property," Butterworth said. The proceeds would go toward the $573,470 in restitution Howland owes consumers, she said.
The interim plan, which was agreed upon outside of court, does not preclude the office from "continuing to look at appropriate measures" for securing the money, Butterworth said.
New Bedford attorney Robert F. Murray, who represents Howland, said he will try to get another extension from the Attorney General's Office if the property does not sell by the April deadline.
Murray first asked for an extension after Howland failed to meet the demands of a 2008 consent agreement that set an Oct. 9, 2009, deadline for the payment of $488,000 in restitution.
As per the agreement, the restitution amount jumped to $638,000 after Howland missed the deadline.
Because Howland paid the office $64,530 in October 2008, his restitution stands at $573,470, Butterworth said.
In March 2007, the Attorney General's Office filed a complaint in Bristol Superior Court and received an emergency court order to shut down WindTech-Co. and place a freeze on Howland's bank accounts.
Howland was accused of violating the Massachusetts Consumer Protection Act by misleading consumers, making false and misleading representations in promoting the sale of wind turbines, failing to install turbines paid for by consumers and providing unsafe wind turbine installations.
Under the consent agreement, Howland is prohibited from operating a business involved in the sale and installation of alternative energy systems, specifically wind turbine and hybrid wind turbine/photo-voltaic systems.
Howland did not return phone calls seeking comment.
Murray said Howland now lives out of state but would not confirm Howland resides in Hawaii.
She is a shoe in in MA. I can't wait until the 2010 general election though. There will be democrats thrown out on their backsides.

there have been two federal special elections since this president took office, both times Democrats WON. One was especially telling, the NEW YORK election where for 100YEARS republicans WON, but not this year on that special election.

I dont always delete them, but when I do, it is for a good reason, for example, these last two posts I tried to copy and paste a link but in both posts the link wouldn't copy onto the format entirely.

Coakley leads by nine in recent polling. She will probably win, but by 10, 12, or even 15 here. BAD SIGN for democrats in 2010.

Scott Brown for me. Terrorists are not entitled to constituional rights as Martha wants. She is also for a 40% tax on so-called 'Cadillac' health plans. Plans that cost more than $23,000/year. So for those with those plans Martha wants to tack on another $9,200. No thanks Martha.
