Gagne suit ruling issued

A Superior Court judge has declined former Executive Administrator Michale Gagne's motion for a preliminary injunction to force the town to retain him in his job and has ruled that his contract was invalid due to its conflict with the Special Act which created his position. I was informed of the decision but do not know if the judge issued a written decision. I will post the information here as I get it.
This is a significant victory for the position ...

...taken by the town and will stand unless appealed by Mr. Gagne.
At this time, I don't know if the judge addressed the open meeting argument which would also shed light on the status of other contracts with this renewal language. I don't think the decision used that argument as a basis for ruling the contract void.

Great news. Now we can get Gagne, Miller, Leduc, and Horan-McLean behind us. Next up: Carney and Dias.

The victory is only for an injunction, not a ruling on the contract.

I am glad to see that at least one contract is behind us! The previous board of Miller,Horan-McLean, Dias, Carney and Leduc really did a disservice to our town when they signed contracts with automatic renewal clauses. I understand that Carney is NOW against them. Isn't that interesting Mr. Carney??? I suppose next election time, Nat will be against them also. How sad.

Be nice if she would just respect herself and all of us and not even run. Why should she be given any credibility now, and for that matter, why should Carney?

To get an injunction the petitioner needs to show he's got a reasonable chance of winning the underlying lawsuit. Mr. Gagne couldn't even show that. This is terrific news for our town, no matter which side of the issue you might have been on when Mr. Gagne originally got voted out. It offers us a period of relative certainty in which the Selectmen can move forward and hire a new Executive Administrator without looking into the rear view mirror every minute. Mr. Gagne's case won't get to trial for a year or two if ever.

There is no evidence of any ethics violation filed against Bill, only innuendo. I wonder who it could be that is starting these nasty rumors. A sore loser from the last election maybe?

Diane Gilbert is a wonderful person. She always takes the time to listen to people. She is honest. She is strong enough to handle the constant nasty attacks against her. I will vote for Diane Gilbert. Integrity and leadership are my reasons.
