Curt Brown's article on the countersuit by Executive Administrator, Michael Gagne, against the Select Board can be found here.
Basically, Mr. Gagne is seeking a preliminary injunction seeking to require the Select Board to rehire him. The basis of the argument is whether or not his contract is legal and binding. The Select Board's suit says it isn't and asks for a judgment that says so. Mr. Gagne's suit says it is and ...
...seeks to force his retention.
The Superior Court will hear arguments on the case on February 12th. Perhaps we will have an answer then.
I intend to post Mr. Gagne's complaint on this blog. I have to scan in the pages and it is somewhat lengthy. I will post a link to it when I get it done.

Interesting how long it took Michael Gagne to decide which direction he wanted to go. I guess he decided to take Nat's advice.
The townspeople should file suit against DIAS & CARNEY for: "Unbecoming a public official". This is for telling GAGNE to sue the town. Their jobs are to lookout for the interest of the town not to encourge litigation.

Although people may say Mike is only looking after the best interest of himself..my question is, who wouldnt try to do the same thing if they felt slighted by their bosses. Just to sit back and take it, is not the way most people handle being slighted. If he feels the SB is wrong let him go forward. Anyone of us would do the same thing if it was us in his position.
I hope you don't mean that. I hope not everyone would have their own best interests in mind when holding an official position in the town. Mr. Gagne was only thinking of himself and a certain few when he involved himself and the town in those contracts. Not only did they not benefit the town but as we now know they have put the town in a bad legal position.
To anon 1:37 pm, I have to agree with you. When the eight contracts were signed, it was done without public knowledge for a reason. The public would have yelled bloody murder! These sweetheart contracts were self serving and only for a chosen few. (Although, Nat claims they were to be for ALL contracts in the town!) They were signed in 2006 when Dartmouth was having fiscal problems. It was a direct effort to protect certain people from lay off or consolidation during fiscal crisis. Atty. Bartulus was right when he said, the contract ties the hands of the town! This was an inside deal. Where does Michael Gagne's responsibility to the town come into play? He didn't care. Just give him one(contract) too!
Part of Mike's public relations strategy is to play victim. It is pretty obvious that he is not. I also think that he has a lot less support throughout the community than he thinks. One can only hope that justice prevails for the people of Dartmouth, but once things get into a court, anything can happen.
exactly anon 10:05 how many of us would quietly in the dark night if this happened to us? He has legal recourse , he feels he's getting hosed so its his legal right to fight for his job. GO mike GO
